Conditions of Entry

1. This competition (the “Competition”) is conducted by AB Food & Beverages Australia Pty Ltd, ABN 93 100 637 849, 35-37 South Corporate Ave, Rowville, Vic 3178 (the “Promoter”).

2. Entry instructions published by the Promoter form part of these conditions.

3. Entry into the Competition is only open to “Eligible Persons”, being individuals who:

(i) are Australian residents;

(ii) are not employees of the Promoter or its related companies or agencies associated with the Competition; and

(iii) are not members of the immediate family of an excluded employee. "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the employee.

4. Persons under 18 years of age are eligible to enter the Competition, but their entitlement to any Prize is subject to the written consent of their parent or guardian (see condition 21).

5. Entry into the Competition commences at 8am on 16/4/07 and closes at 11.59pm time on 27/5/07 ("Competition Period"). All Competition times are Sydney time.

6. To enter the Competition, an Eligible Person must first purchase an ULTRAslim product from a Coles supermarket (excludes Coles Central, Coles Online, Coles Express and Pick n Pay stores) (a “Qualifying Product”) during the Competition Period.

7. An Eligible Person may enter the Competition once each time they purchase a Qualifying Product during the Competition Period. For each entry, one SMS must be sent in accordance with condition 8.

8. Eligible Persons may enter the Competition by sending an SMS message to 1999 7777. To do so, they must:

(i) use a mobile phone and service with the ability to send SMS messages to premium numbers (the Promoter will only accept SMS entries submitted using a mobile phone; it may reject SMS entries if it reasonably forms the opinion that they have been entered using other entry means, including the internet or automated means); and

(ii) send an SMS comprising, with a space between each item: (a) the last five digits of the barcode of the Qualifying Product purchased (b) their first name; (c) their last name; and (d) their residential postcode; and

(iii) ensure that their entries are made correctly and sufficiently early to be received by the Promoter during the Competition Period.

9. No more than 5 SMS entries may be made by any Eligible Person on any single day. No more than 5 SMS entries will be accepted on the same day from any single mobile phone number.

10. Each SMS sent to make an entry will cost the person sending it 55 cents, including GST.

11. The Promoter takes no responsibility for any delays or failures in any telecommunications service.

12. In reply to each SMS entry received, the Promoter will send (to the mobile phone identified as the number from which the entry was sent) an SMS confirming receipt of the entry.

13. The Promoter will reject invalid entries. Rejection may occur: (i) before or at the time the SMS confirming receipt is sent; or (ii) at any later time, including after the draw is made. If an invalid entry is identified by the time the SMS confirming receipt is sent, the SMS confirmation may report the error to the entrant and invite the entrant to submit another entry. If the Eligible Person submits another entry, the Eligible Person will incur another SMS charge.

14. The Competition draws will commence at 11am on 29/5/07 at Level 12, 114 William Street, Melbourne VIC 3000.

15. There are 5 Prizes altogether. The Eligible Persons submitting the first valid entry drawn from each of: (i) NSW/ACT; (ii) VIC/TAS; (iii) SA/NT; (iv) WA; and (v) QLD (each a "Region"), will each win a Prize. The postcode indicated in each drawn entry will be used to conclusively determine the Region from which the entry was made.

16. Each Prize comprises a Target Gift Card, valued at $2,000 and a virtual trainer package as detailed below, valued at $150. The total value of each Prize is $2,150.

17. The total value of all 5 Prizes is $10,750. Prizes are valued as at 23/2/07. The Promoter takes no responsibility for any variations in Prize values.

18. The Target Gift Cards are redeemable at Target, Baby Target and Target Country stores and are issued subject to such conditions and exclusions as may be imposed by the Card issuer from time to time. Please see in-store, visit giftcards.com.au or call 1300 304 990.

19. The virtual trainer package comprises a 6 week membership for the winner of the Online Fitness program (the “Program”) conducted through getfit.com.au (which includes personalised exercise programs, dietary advice and meal plans, personal replies to a member’s questions, continual motivation and guidance, a monthly newsletter including the latest fitness tips and access 24/7 to the member's online trainer). To receive the benefits of the Program, a winner must have continuing access to the getfit.com.au website. Winners should consult with their doctor before joining the Program.

20. Entrants will be notified by SMS if their entry is drawn. The SMS notification will be sent to the mobile phone number from which the drawn entry was sent. The person entitled to each Prize is the person who: (i) has the name appearing in the drawn entry for that Prize; and (ii) can produce, if requested, a photocopy of the receipt(s) required by condition 21(i). Any other person receiving a winning notification at the mobile phone number from which the drawn entry was sent (whether as a result of being the registered owner of the phone account or otherwise) has no entitlement to the Prize.

21. In order to be entitled to a Prize, an Eligible Person whose valid entry is drawn MUST, if requested by the Promoter, within 7 days of being asked to do so:

(i) hand over to the Promoter, at no cost to the Eligible Entrant, a photocopy of the receipt(s) used to submit any or all entries made by the person and, in particular (but without limitation), the receipt for the Qualifying Product that was used to submit the drawn entry;

(ii) agree to, sign and return the Promoter's form confirming their eligibility to accept the Prize or participate in the Program;

(iii) agree to, sign and return any liability release and/or indemnity form requested by the Promoter and/or any entity associated with this Competition. If the Eligible Person is under 18 years of age, in order to be entitled to a Prize, the Eligible Person must ensure that their parent or guardian also signs the documents referred to at (i) and(iii) above (if requested by the Promoter). An Eligible Person who does not comply with this condition 21 forfeits the Prize.

22. The Promoter reserves the right to verify the validity of entries and to disqualify any Eligible Person who:

(i) tampers with the entry process;

(ii) makes entries in breach of these conditions;

(iii) is unable to produce a valid receipt substantiating any entry made (whether winning or not); or (iv) subverts these conditions. Any Eligible Person who is disqualified will lose any entitlement they may have to any Prize.

23. The names of the Prize winners will be published in The Australian on 7/6/07.

24. Subject, where relevant, to any directions given under the legislation regulating the Competition, if any Prize is not claimed by an Eligible Person within 3 months of the draw, the Prize will be awarded to another Eligible Person from the same Region in another draw (the “Unclaimed Prize Draw”) for that Prize. The Unclaimed Prize Draw will be made from all the other entries from that Region in the original draw. The Unclaimed Prize Draw(s) will commence at 11am on 10/9/07 at Level 12, 114 William Street, Melbourne 3000.

25. If any Prize is awarded to an Eligible Person and that Eligible Person then forfeits the Prize for any reason, including as a result of:

(i) failure to comply with condition 21; or

(ii) disqualification (as contemplated by condition 22), the Prize will be awarded to another Eligible Person in another draw for that Prize (which draw will be made from all the other Eligible Persons' entries allocated to the original draw for that Prize). The additional draw will take place immediately after the Unclaimed Prize Draw at the same place as the Unclaimed Prize Draw.

26. The names of the Prize winners in the Unclaimed Prize Draw and the draw under condition 25 will be published in The Australian on 21/9/07.

27. To the full extent permitted by law, the Promoter and its associated companies and agencies and any of their personnel (the "Relevant Parties") shall not be liable for any loss (including any damage, claim, injury, cost or expense) whatsoever which is suffered or incurred arising out of, or in any way connected with, the Competition or Prizes, including:

(i) any indirect, economic or consequential loss;

(ii) any loss arising from any negligent act or omission of any of the Relevant Parties; and

(iii) any liability for personal injury or death.

28. All of the Promoter’s decisions are final and no correspondence will be entered into.

29. Prizes and rights to receive Prizes, including any unused part of them, are not transferable or exchangeable and cannot be taken as cash, except with the written consent of the Promoter. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.

30. If for any reason the administration security, fairness, integrity or proper conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition. Any cancellation, termination, modification or suspension that relates to the Competition will be subject to the approval of the authorities that have issued permits for its conduct.

31. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorized access to, or alteration or non-receipt of Eligible Person's communications. The Promoter is not responsible for any problems or technical malfunctions (such as problems with telephone networks or lines, computer systems or software or internet service providers) or any failure of any SMS communication to be received by the Promoter (whether as a result of technical problems or traffic congestion on any carrier network).

32. In the event that any Prize is not available for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by an Eligible Person or any third party in the event that any scheduled Prize is unavailable for any reason.

33. Eligible Persons consent to the Promoter using the Eligible Person's name, likeness, image and/or voice in the event they are a winner of a draw (including any photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition, the Promoter or its products and services.

34. Eligible Persons' personal information will be collected by or on behalf of the Promoter to enable it to administer and promote the Competition and the winners of the Competition’s draws. The personal information of winners may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to authorities that regulate the Competition. Eligible Persons may contact the Promoter at the address above to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Person does not provide accurate personal information the Promoter may determine that they are not eligible to win a Prize.
